APPEALS (HIGHLIGHTS)

  1. Sierra Club v. Lynn, 502 F.2d 43 (5th Cir. 1974), a suit under N.E.P.A., which resulted in a reversal of an award by the trial court of attorney fees to the plaintiff.
  2. Brown v. Brown, 520 S.W.2d 571 (Tex. Civ. App.-Houston [14 th Dist.] 1975), an unusual suit for divorce, involving a default judgment.
  3. Town & Country Mobile Homes v. Stiles, 543 S.W.2d 664 (Tex. Civ. App. - El Paso 1976, no writ), which resulted in a reversal and remand on the appeal of my client. This was an early DTPA suit.
  4. Whiteside v. Dresser, 543 S.W.2d 158 (Tex. Civ. App. - Waco 1976, writ ref'd n.r.e.), which resulted in a reversal on the appeal of my client. This was a family law suit.
  5. Tom Benson Chevrolet Co. v. Beall, 567 S.W.2d 857 (Tex. Civ. App. - San Antonio 1978, writ ref'd n.r.e.), which resulted in a reversal on the appeal of my client. This was a garnishment suit.
  6. U.S. v. Patterson, 792 F.2d 531 (5 th Cir. 1986), a federal arson case in which the question was whether the government proved the jurisdictional element of interstate commerce.
  7. Davis v. Grammar, 750 S.W.2d 766 (Tex. 1998), which resulted in a reversal by the Supreme Court (in favor of my client) of the take-nothing judgment rendered by the trial court and court of appeals against my client, and a remand for entry of judgment reforming a deed because of mutual mistake in the description of the real estate conveyed by my client to the defendant. This was a mutual mistake suit.
  8. Sears, Roebuck and Co. v. Robert Kunze, 996 S.W.2d 416 (Tex. App. - Beaumont 1999, petition denied), a product liability suit which involved issues relating to a finding by a Beaumont jury of gross negligence against my client, relating to the proper construction of the statutory cap on exemplary damages, relating to the exclusion under Robinson (Daubert) of evidence offered by my client that involved litigation testing conducted by BRC for the purpose of proving that the accident did not occur as alleged by plaintiff, relating to the admission over a hearsay objection of "other accident evidence" offered by plaintiff to prove that my client had notice of ninety-five other accidents which plaintiff claimed were reasonably similar to the accident in question, and relating to the post-verdict claim that a refusal to find design defect is in fatal conflict with a general finding of negligence (or a finding of negligent design, based on the evidence offered). Scott J. Atlas, Penny Nicholson and Gwen J. Samora, of Vinson & Elkins, Houston were the attorneys in charge on appeal. Mr. Kunze brought that suit as a result of the amputation of four fingers while using a Sears Craftsman radial saw. The CPSC recalled the line of saws soon after the verdict, partly because Emerson had, before the trial, improved the guarding system, which was admitted into evidence as a subsequent remedial measure. My co-counsel was Adam Peck. This is a product liability suit.
  9. Rankin v. Methodist Healthcare System of San Antonio, 307 S.W.3d 283 (Tex. 2010), a medical malpractice case involving the question of whether the application of the ten-year statute of repose to the cause of action for negligent failure to remove a surgical sponge would be unconstitutional under the state constitutional right under the open courts provision.
  10. Hall v. Seal, 2011 WL 61631 (Tex. App. - San Antonio 2011, pet. denied), a case involving claims of nuisance and trespass, and also involving the Texas Right to Farm Act. The Court of Appeals reversed on my clients' appeal.
